Terms of Service

By accessing or using the Artelyara platform, you agree to be bound by these Terms of Service. If you do not agree to all of these terms, you may not use our services. We reserve the right to modify these terms at any time, and your continued use of the platform constitutes acceptance of any changes.

To participate in auctions, you must create an account and provide accurate, complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must be at least 18 years old to create an account.

Artelyara reserves the right to suspend or terminate accounts that violate these terms or engage in fraudulent activity.

All bids placed on Artelyara are binding commitments to purchase the artwork at the bid price plus the applicable buyer's premium. Bids cannot be retracted once placed. Each auction has a defined end time, and the highest bidder at the close of the auction wins the lot.

Artelyara employs a timed-auction format. If a bid is placed in the final minutes of an auction, the closing time may be extended to allow other bidders a fair opportunity to respond.

Buyers pay the listed price or winning bid amount, plus any applicable shipping costs. A platform commission is deducted from the artist's payout to cover platform operations, payment processing, and buyer protection.

Artists listing works on Artelyara represent and warrant that they are the rightful owners of the artwork and have the legal right to sell it. Artists must provide accurate descriptions, dimensions, medium, and condition reports. Misrepresentation of artwork may result in account suspension and liability for damages.

Artists are responsible for shipping sold works to buyers within the timeframe specified in the listing. The hammer price, less the platform commission described above, is remitted to the artist after the order is completed.

Users may not engage in shill bidding, bid manipulation, or any form of auction fraud. Listing counterfeit, stolen, or misattributed artwork is strictly prohibited. Users may not use automated tools to place bids or scrape platform data. Harassment of other users, artists, or staff will result in immediate account termination.

Artelyara acts as a marketplace connecting artists and collectors. We do not take possession of or authenticate artworks listed on the platform. While we take reasonable measures to verify artist identities and listing accuracy, Artelyara is not liable for disputes between buyers and sellers beyond the protections outlined in our Buyer Protection policy.

To the maximum extent permitted by law, Artelyara shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the platform.

We may update these Terms of Service from time to time. When we make material changes, we will notify registered users via email and post a notice on the platform. The “Last updated” date at the top of this page reflects the most recent revision. Continued use of Artelyara after changes are posted constitutes acceptance of the revised terms.
